BUCYRUS—A Marion man who had bonded out of jail on one occasion picked up a new felony after he allegedly threatened a witness.
Robert Toombs, 33, of Marion had been free after he posted a $50,000 bond after Toombs was charged with original charges. Including two third-degree felonies of aggravated trafficking in drugs, each punishable with up to 36 months in prison and one count of trafficking in drugs, a fourth-degree felony punishable with up to 18 months in prison.
While on bond, Toombs was charged with one count of intimidation after he allegedly threatened a person set to testify against him. Intimidation is a felony of the third degree punishable with up to 36 months in prison.
Crawford County Common Pleas Court Judge Sean Leuthold set bond at $250,000. He appointed Brian Gernert to the new case since he represents Toombs on the original charges.
Nicholas Paynter, 28, of Bucyrus, appeared via video from the Crawford County Jail to face allegations that he violated the terms and conditions of his community control.
Paynter pleaded guilty in 2020 to one count of drug possession, a fifth-degree felony punishable with up to 12 months in prison.
According to probation officer Jeremy Clay, Paynter tested positive in May for methamphetamines. The results were confirmed by a lab.
Assistant Prosecutor Ryan Hoovler asked for a $75,000 bond to protect the public and Paynter himself from his drug use.
Paynter told the court he needed a personal recognizance bond to complete work on his house. He indicated he intended to go to prison and get the charges behind him.
Judge Leuthold ordered the matter set for a full hearing. He reappointed attorney Tom Nicholson to represent Paynter.
Judge Leuthold found Paynter in contempt after he muttered a profanity. He sentenced Paynter to an additional ten days in jail for the infraction. “This was spoken out of frustration with no threats. That’s why I’m only giving Mr. Paynter an additional ten days in jail. You cannot drop the F-Bomb in court. It will not be tolerated.” Leuthold said.
