BUCYRUS, OH (CRAWFORD COUNTY NOW)—In his opening statements to the jury in the felonious assault trial of his client Timothy Carnes, 42, Attorney Tom Nicholson asked the jury to look beyond what the state says about his client to what they do not say.

Nicholson told the jury his client has never admitted to hitting his wife. He told the jury they would see his ripped shirt as evidence that Tiffany was the aggressor.

Nicholson contended that on the night in question, Tiffany had been up for days due to meth use. In fact, that night, he claims she picked up meth balls to take to Carnes’s house.

Nicholson contends that Carnes waited at least 8 hours to get treatment and questions just how serious her injuries were. Nicholson told the jury that at the hospital, the victim tested positive for methamphetamines, meth, marijuana, and prescription drugs.

Nicholson said the difference in their stories is much like the book Men Are From Mars. Women Are From Venus…completely different.

He described the two equally verbally abusing one another. He told the jury they would see the text exchanges and hear from his client about what really happened that night.

He told the jury they were witnessing the deterioration of a family that was facing divorce, foreclosure, criminal cases, and a child protection services investigation.

Nicholson told the jury that during their two-year separation, they both had other romantic partners. Nicholson contends that Tiffany

Carnes was mad because another woman was sleeping in her bed.

He told the jury that five weeks before the incident, Tiffany Carnes went to the ER because she had fallen in the shower. He told the jury that the daughter’s friend would testify that he heard the commotion but never saw Timothy Carnes hit his wife.

He told the jury he believed at the conclusion of testimony there would be no proof of serious physical harm to his client’s wife and that she was mad at him.

Testimony will continue.
