BUCYRUS—Barton DeWitt, 57, of Crestline, reappeared in Crawford County Common Pleas Court on Monday to sign an extradition order from the state of Oregon.
DeWitt is charged in Oregon with one class A felony and nine class two felonies that include eight counts of sexual abuse, one count of unlawful penetration, and one count of the intent to commit felony sodomy.
Crawford County Common Pleas Court Judge appointed attorney Jerry Thompson to advise DeWitt of his legal right regarding extradition after he told Leuthold he had no ties to the state.
Attorney Ben Kitzler who works with Thompson addressed the court on De Witt’s behalf:
“Mr. DeWitt wanted you, Your Honor (Leuthold), to preside over this case because he has the utmost respect for you. I explained that it was not possible, and he is prepared to sign,” Kitzler said.
Judge Leuthold explained to DeWitt that the state of Oregon has ten business days to retrieve him from the Crawford County Jail. If they do not pick him up, he will appear before Judge Leuthold, and bond will be set.
Timothy Lamont Benford Jr., 38, agreed to be extradited to the state of Maryland.
He is facing first and second-degree felonies of assault, reckless endangerment, and theft.
The state of Maryland has ten business days to retrieve Benford from the Crawford County Jail. Benford will return to Common Pleas Court for a bond hearing if they fail to meet the deadline.
