
BUCYRUS—Three co-defendants were arraigned in Crawford County Common Pleas Court on Thursday on charges of felonious assault. If convicted of a second-degree felony, they could each face up to eight years in prison.
The assault took place after the three had an altercation at a Crestline bar. The Crestline Police responded to the bar. The bartender asked the defendants and the victim to all leave the bar.
Police were called back to a residence in the area about a half-hour later. Apparently, the victim and defendants ended up on the same street. A witness was awakened by a noise and witnessed all three of the defendants beat the victim unconscious and then continued to beat him. The witness told police the victim did nothing to fight back.
Jaqueline Montgomery, 43, of Crestline, retained Mansfield attorney James Mayer III to represent her. He entered a not guilty plea on her behalf.
According to Assistant Prosecutor Ryan Hoovler, Jaqueline Montgomery kicked the victim in the head after he was unconscious.
Crawford County Common Pleas Court Judge Sean Leuthold set her bond at 100,000.
Timothy Montgomery, the husband of Jaqueline Montgomery, told the court he is hiring an attorney. Judge Leuthold told Montgomery that if he hadn’t retained an attorney by the immediate and next pretrial, he would appoint him an attorney. Attorney Tom Nicholson represented Montgomery for purposes of bond.
According to Prosecutor Matt Crall, Timothy Montgomery denied being part of the assault but had blood on his shirt. The witness told police that Montgomery went to check on the victim when the third defendant was beating him. He allegedly picked up his head and declared the victim got what he deserved. The witness said that both of the Montgomery defendants kicked and hit an unconscious victim. Judge Leuthold set his bond at $100,000 as well.
The third defendant, Cameron Davis, 49, of Crestline, was, according to the witness, the most aggressive. He allegedly sat on the victim, beat him, and kicked him. He allegedly told the police that the unconscious victim did not fight back.
Prosecutor Crall said there are allegations that the victim pushed the female defendant down in the bar earlier in the evening, but that so far, the video from the bar has not confirmed that.
Crall said the victim suffered several fractures to his skull, a broken left ankle, two broken jaws, and multiple skull fractures.
Crall told the court that surgery to relieve pressure from the victim’s brain had to be postponed until doctors felt he would survive the surgery. So far, even though the surgery was performed, the victim has not regained consciousness. Crall said his survival is unsure. Prosecutors have not been able to obtain a statement from the victim.
Leuthold entered a not guilty plea on Davis’ behalf and appointed attorney Jerry Thompson to represent him. Bond was set at $150,000.
