Monday morning began on the wrong foot for one Crawford County man who found himself in front of Judge Sean Leuthold on charges of Improper Handling of a Firearm a fourth degree felony. Brent Brewer drew the judge’s ire with his bad attitude.
“I heard you talking in the hallway and saw your attitude and I don’t like it, Leuthold warned.
When Brewer tried to ask a question, the Judge admonished him again saying, “This is not a question and answer session, this is an arraignment”.
Before placing him on a personal recognizance bond, Leuthold warned him that he didn’t have to let him just walk out of the court. Brewer apologized and the matter will be set for pre-trial.
Later in the day, when defendant Tiffany Eaches faced the judge he meted justice with compassion. Eaches was charged with violating her community control when she tested positive for Gabapentin and alcohol on June 14, 2017.
Eaches had been in Judge Leuthold’s ISAT (Intensified Supervision and Treatment) program for seven months when she admittedly reported she was struggling with relapse. Though she tested positive for the substances, Judge Leuthold acknowledged her admission that she was struggling.
Leuthold also noted that Gabapentin is not an opiate.
“There is no small slip up in this county anymore. We are not going to lose you,” Leuthold said.
With that being said, Leuthold ordered Eaches to be admitted to Crosswaeh Community Based Correctional Facility in Tiffin, Ohio. Upon completion of her program at Crosswaeh, she will be readmitted into the judge’s ISAT program.
Saving the worst for last, Judge Leuthold explained in detail the prison time facing Martin W. Nolen. He is charged on one count of Rape, a felony in the first degree.
If convicted, Nolen faces one of three sentences. Life without Parole, 25 Years to Life, or if force was involved, a flat thirty-year sentence. Nolen was indicted for sexual misconduct with someone other than his spouse and under the age of thirteen. In this case the alleged victim is seven years old.
Attorney Adam Stone is representing Nolen and is seeking a competency evaluation as part his defense of Nolen. Bond was set at $500,000.
Other arraignments included: Ashley Washington for Possession of Oxycodone, a 3rd degree felony. Bond was continued at $50,000.00 and attorney Sebastian Berger was appointed to defend her. Sarah Thornton faces probation violation and tampering with evidence, a 3rd degree felony punishable with 36 months in jail and a $10,000.00 fine. Her bond was set at $75,000.00 and attorney Brad Starkey appointed to represent her. Scotty Sharrock was charged with a 5th degree felony on Theft. He faces 12 months in prison and a $2500 fine. Attorney Grant Garverick was appointed his attorney and bond was continued at $50,000.00. Zack Carroll is charged with Aggravated Burglary a first degree felony punishable with up to 11 years in prison. Bond was set at $250,000.00 and attorney Jim Mayer was appointed to represent him. Hollijene Williams faced three counts including Possession of Drugs, a 5th degree felony, Receiving Stolen Property, a 4th degree felony, and possession of drug abuse instruments a second degree misdemeanor. She faces up to 18 months in prison. Bond was continued at $50,000.00. Attorney Brad Starkey will be her attorney. Zachary Bishop, Complicity and threats against a Corrections Officer a third degree felony, bond was set at $100,000.000 and attorney Andy Motter was appointed as counsel. Nicholas Davis faces two third degree felonies for Retaliation and Intimidation. Bond was set at $100,000.00. Attorney Sebastian Berger will be court appointed counsel. Johnathon Marks, Parole Violation a felony of the 5th degree, bond was set at $50,000 and attorney Tom Nicholson was appointed as counsel.
