BUCYRUS—Crawford County Common Pleas Court Judge Sean Leuthold sent a strong message to a Marion man who pleaded guilty to trafficking in drugs.
Robert Toombs, 33, of Marion pleaded guilty to two third-degree felonies of trafficking in drugs, each punishable with up to 36 months in prison and one count of aggravated trafficking in drugs, a felony of the fourth degree punishable with up to 18 months in prison.
In an agreed plea negotiation, Judge Leuthold sentenced Toombs to 11months in prison on the fourth-degree felony and 24 months in prison on each of the third-degree felonies for a total of 59 months in prison.
Leuthold expressed his concerns with drug trafficking in Crawford County;
“Methamphetamines are dangerous drugs that are often laced with fentanyl. I am concerned that drug overdoses will rise. When you use drugs, you endanger yourself, but when you traffic in them, you’re endangering other lives. That’s why you’re going to prison.” Leuthold said.
In other court news Kevin Neely, 39, of Galion, pleaded guilty to burglary, a felony of the fourth degree punishable with up to 18 months in prison. In an agreed plea negotiation, Judge Leuthold sentenced Neely to a flatten months in prison. He told Neely he would not oppose transitional control if the prison requested it.
Ricky McCleese was indicted on a 2017 possession of heroin charge, a felony of the fifth degree punishable with up to 12 months in prison. The indictment was a result of an overdose. Judge Leuthold entered a not guilty plea on McCleese’s behalf and appointed attorney Brian Gernert to represent him.
Because of the age of the case, The state agreed to a personal recognizance bond. They requested and received a special condition on the bond that McCleese gets a drug and alcohol assessment started immediately.
Martin Wyeth, 48, of Bucyrus pleaded guilty to one count of possession of drugs, a felony of the fifth degree punishable with up to 12 months in prison. A charge of tampering with evidence was dismissed.
Judge Leuthold sentenced Wyeth to a flat-six months in prison. He will forfeit all drug-related property and will receive 60 days of jail time credit.
