Ohio law once again halted a first-time offender from being sent to prison but Judge Sean Leuthold made it clear that previous behaviors would no longer be tolerated.

Thirty-six-year-old Nicholas Daigle of Plain City was sentenced to five years on community control in Crawford County Common Pleas Court Wednesday afternoon. In addition to the probation, he received a $2,000 fine, a six-month driver’s license suspension, and entrance into a drug and alcohol treatment program. He must also forfeit drug-related property being held to the Ohio State Highway Patrol.

“I see irresponsible behavior followed by irresponsible behavior followed by irresponsible behavior,” Judge Leuthold said as he thumbed through Daigle’s record citing driving on the wrong side of the road and OVI along with other incidences.

Judge Leuthold warned Daigle that he could be sentenced to 24 months in prison – 12 months for each drug possession charge – if he failed to complete his community.

Gregory Brown pleaded guilty to having weapons under disability, a third-degree felony. The 58-year-old Galion man was released on a personal recognizance bond due to health reasons while a pre-sentence investigation is conducted. It was recommended that Brown be placed on community control for one year but serve 90 days in the county jail. He must also undergo drug and alcohol treatment. If Brown fails on community control he could be sentenced to 36 months in prison.
