BUCYRUS—David Pasco, 23, of Dunkirk, was arraigned in Crawford County Common Pleas Court on Monday. Pasco is charged with one count of tampering with evidence, a felony of the third degree punishable with up to 36 months in prison, and one count of possession of marijuana, a minor misdemeanor punishable with a $150.00 fine.
According to Pasco’s attorney Rocky Ratliff of Marion, his client posted a $10,000.00 after his arrest and completed a 15 day period of house arrest prior to his court appearance.
Assistant Prosecutor Ryan Hoovler told the court that if Pasco submitted to and passed a drug test, he would agree to a personal recognizance bond.
Ratliff conferred with his client, who agreed to take the test.
After a brief recess, Crawford County Common Pleas Court Judge Sean Leuthold asked probation officer Chris Heydinger for the results. Heydinger reported that Pasco tested positive for meth and methamphetamines.
Hoovler told the court that the tampering with evidence charge was the result of a drug investigation and that Pasco admitted to officers he had used meth.
Judge Leuthold inquired with Jail Superintendent Kent Rachel about jail capability. Rachel reported that several transfers to prison are pending.
Assistant Prosecutor Ryan Hoovler asked the court for a brief recess to discuss bond with attorney Ratliff.
In an agreed joint bond recommendation, the state asked that Pasco’s bond be continued with the condition he would drug test weekly with adult probation.
Judge Leuthold agreed to the recommendation but added an additional sanction of complete house arrest. Pasco immediately asked the Judge if he could go to work at his family’s meat processing establishment; “Nope, if I let you leave for work, that gives you the opportunity to stop somewhere on the way or meet somebody at work.. who knows.” Leuthold said.
Leuthold told Pasco the only time he can leave home is to test on Monday mornings at 9 am with adult probation. It’s there and back. If he fails a drug test, take him into custody.” Leuthold said.
In other court news, a warrant for failure to appear at a pretrial was issued for Haily England,24, of Plymouth. England was granted a personal recognizance bond at her initial arraignment but was a no-show today in court. England is charged with one count of possession of drugs. A felony of the fifth degree punishable with up to 12 months in prison.
Coty Wilson, 33, of Bucyrus, pleaded guilty to one count of criminal nonsupport, a felony of the fifth degree punishable with up to 12 months in prison.
In an agreed plea negotiation, Wilson was permitted to participate in the Prosecutor’s Diversion Program. He was placed on five years of community control l. If he pays all arrearages and stays current on child support payments, the felony charges could be dismissed.
Curtis Smathers, 33, of Bucyrus, pleaded guilty to one count of criminal nonsupport, a felony of the fifth degree punishable with up to 12 months in prison.
Judge Leuthold placed Smathers on five years of community control. He must stay current in his child support payments and pay arrears in excess of $30,000.00. If he fails to comply, he faces 12 months in prison.
