Gary Fox was back in Common Pleas Court on Monday and by the time his hearing was over he was headed back to prison as a result of an error – not his, but an administrative one.

But even given that’s Fox’s return was not specifically due to his breaking the law again, he still managed to get himself admonished for his attitude by Judge Sean Leuthold.

The judge explained that when Fox had previously been sentenced to eight months in prison for violating his community control from a 2012 case an administrative error in calculating jail credit resulted in him serving just a matter of days. Wishing to determine a way to correct the situation to the satisfaction of everyone, a hearing was scheduled for which Fox did not appear. As a result the court issued a warrant and Fox was arrested in late November.

It was during that explanation, the judge became irritated with the defendant’s attitude and strictly warned him, “I do not have to do this.”

As a result of negations, the 43-year-old Fox, of Galion, was re-sentenced to six months in prison with credit for his most recent prison stay, as well as proper jail credit for time served prior to his previous sentence and time served since being picked up on the warrant.

Fox’s original conviction in the 2012 case was for fifth-degree felony drug possession.

Forty-year-old Christina Ray of Columbus pleaded guilty Monday morning to a bill of information alleging she had been in possession of methadone with is a controlled substance and a fifth-degree felony.

The recommended sentence is five years on community control, completion of an approved alcohol and drug treatment program, $1,250 fine, and six-month driver’s license suspension.

Ray must also forfeit all drug-related items to the Crestline Police Department. Ray was released on a personal recognizance bond until a pre-sentence investigation is completed and she is formally sentenced.
