BUCYRUS — Noah Johnson of Lima appeared in Crawford County Common Pleas Court on Monday after he was arrested for a community control violation. Johnson was placed on five years of community control in 2017 after he pleaded guilty to assaulting a peace officer.
According to probation officer Eric Bohach, Johnson, 31, was recently charged with sexual assault after he had sexual contact with a person impaired or incapacitated to the point they could not give permission for sexual contact. The alleged crime occurred in Van Wert.
Common Pleas Court Judge Sean Leuthold was shocked to see Johnson in court. Johnson told Leuthold he was given a personal recognizance bond on the charge.
“You got a PR bond on a sexual assault charge? I can’t believe it,” Leuthold said.
Johnson made a general admission to violating the terms and conditions of his community control on the advice of his court appointed attorney, Geoff Stoll.
Leuthold sentenced Johnson to a flat seven months in prison on the community control violation. The new charges are not in Leuthold’s jurisdiction.
In other court news, Michael Lucas, 29, of Bucyrus was sentenced to five years of community control after he pleaded guilty to violating two restraining orders, each fifth-degree felonies and each punishable with up to one year in prison. Leuthold ordered Lucas to complete anger management and domestic violence assessments and treatments. He is to have no contact with the victim.
Tiffany Eaches, 29, of Nevada admitted to violating the terms and conditions of her community control. Eaches was placed on community control in 2016 after she pleaded guilty to theft and forgery charges. She violated her community control in 2017 and was sent to drug and alcohol treatment.
According to probation officer Bohach, Eaches refused a urine drug screen, failed to report when ordered into the probation office, had a recent encounter with law enforcement that she did not report and failed a drug screen prior to court.
Eaches appeared in court in a wheelchair for the proceedings. Leuthold decided to send Eaches to a community controlled correctional-based facility for further treatment.
“This is the absolute last shot for you,” Leuthold said. “You do well for a long time and then you go back to this nonsense.”
Because of current health conditions, Leuthold put Eaches on complete house arrest until a bed can be secured for her at Crosswaeh of Tiffin.
“Let me tell you something: Your health concerns will not stop me from putting you in prison. In fact, they have medical facilities in prison, and it would be easier than this,” Leuthold said. “When I tell you complete house arrest that means you do not leave your mother’s house. If you need food or medicine or whatever, your mom will have to get it. Don’t leave your house under any circumstances.”
Cameron Patterson, 27, of Bucyrus pleaded guilty to one count of possession of drugs. In a plea negotiation, Patterson was sentenced to one year in prison with a judicial release in the immediate future. He will receive 47 days of jail time credit and will forfeit all drug related property to the Galion Police Department.
