BUCYRUS–A civil lawsuit filed Monday in the Delaware County Common Pleas Court accuses Attorney Adam Stone of negligence, fraud, and intentional infliction of emotional distress.
The suit, filed by Mindy Straker, who is represented by Columbus Attorney Rob Miller, is seeking damages in excess of $25,000 from Stone and his firm of EYER, STONE, LTD of Bucyrus. The firm itself is named in the lawsuit even though the Strakers retained Stone long before Eyer joined the firm.
The lawsuit is the next step after a complaint filed in February (With the Ohio Board of Professional Conduct)by Dan and Mindy Straker, parents of Brandon Baxter. They allege that Stone lied by saying he was working with the Ohio Attorney General to bring murder charges against Baxter’s widow.
Brandon died by what was presumed to be a suicide on August 9, 2016. However, the Franklin County Coroner issued a report stating that his cause of death was undetermined.
Brandon’s family believed Brandon died at the hands of his wife.
The Strakers now say the window of opportunity to bring a wrongful death case against their son’s widow has exceeded the statute of limitations. Monies they are seeking include a $28,000 fee they paid Stone for a crime scene reenactment.
Crawford County Now reached out to the Straker’s attorney Rob Miller and received the following statement:
“I feel for the Strakers with all they’ve been through. As a member of the Ohio Bar, I’m embarrassed by how they were treated by Mr. Stone. I hope to reestablish their trust in our justice system by holding Mr. Stone to account for his egregious behavior. Mr. Stone, will, of course, have the opportunity to defend his actions. We look forward to hearing his explanation.”
