A Galion man may have more to worry about than just community control violations.
Kyle Presley, 33, had been on community control after having pleaded guilty to a felony three theft charge, a felony three forgery charge, and a felony five breaking and entering charge in 2012. He admitted in Crawford County Common Pleas Court Wednesday afternoon to testing positive for cocaine, benzodiazepines, and opiates on Dec. 28, 2013, failing to report to his monthly office visits since March 7, and failing to complete his court-ordered substance abuse program.
As part of his agreement to admitting to the violations, Presley was sentenced to serve an eight-month sentence on count one concurrent with a 24-month sentence on court two. Those sentences will be served consecutively with a 24-month sentence on count three for a total of 48 months. Presley could receive judicial release after 24 months.
After taking care of his troubles in Crawford County, Presley will now have to face multiple felony charges in Richland County, including theft, forgery, drug possession and burglary.
An amended burglary charge is sending Jamie Davis to prison for a time. The 24-year-old Davis pleaded guilty to a felony three burglary charge, amended down from a felony two. She admitted to trespassing at 588 Bucyrus-Nevada Rd. with the intent to commit a crime on Aug. 31, 2012.
Davis was sentenced to three years in prison with possible judicial release after six months. Davis was ordered to undergo a drug and alcohol assessment as well as pay a $750 fine and $5,125 in restitution to Joyce Bloomfield.
Kevin Foust will get one more chance to kick his drug habit. The 21-year-old Foust had served time in prison on a felony four aggravated assault charge in 2011 but violated the terms of his community control after he had been released. He admitted to failing to report to his office visits and testing positive for THC, cocaine, and opiates. Judge Russell Wiseman continued Foust’s community control with the condition that he enters the Volunteers of America substance abuse program. Foust will be held in the county jail until he can be transported to the halfway house.
