Two people received 36-month prison sentences Wednesday afternoon while a third will have to serve the balance remaining on his original four-year sentence.

Katlyn Marie Benjamin - probation violation, domestic violence, felonious assaultTwenty-six-year-old Katlyn Benjamin, of Galion, pleaded guilty to felony 3 domestic violence in Crawford County Common Pleas Court. She was ordered to serve 36 months in prison – the maximum sentence on the charge – while a charge of felonious assault was dismissed as part of her agreement. Benjamin will have to pay restitution to the victim in an amount to be determined.

Judge Sean Leuthold dismissed a fine in favor of having Benjamin pay the restitution, especially after hearing that her victim sustained lacerations from a broken bottle. She was ordered to have no contact with the victim.

Sean Hazelton appeared in front of Leuthold in March for violating his probation, but he did Sean Lee Hazelton - Probation violationnot last long on his third chance with the judge who is known for not handing out any extra chances too often.

The 22-year-old Mansfield man admitted to violating his community control by failing to maintain his address, being found overdosed twice in Richland County, and being found in associating with a felon.

“Mr. Hazelton is a danger, number one, to himself,” Leuthold said as he noted Hazelton’s two overdoses. “Treatment with him has been a colossal failure.”

Leuthold added that if he did not put Hazelton in prison, he would hold himself accountable as he believed he would soon be signing Hazelton’s death warrant.

Hazelton was sentenced to 36 months in prison. He could be released early into a treatment program, but Leuthold cautioned that would not occur until well into his sentence.

Robert Walter Posey III - Probation violation, domestic violenceRobert Posey III will be spending the balance of his original four-year prison sentence after he admitted to violating his probation.

The 33-year-old Bucyrus man admitted to committing domestic violence on July 9 and was found to have violated the terms of his probation. Posey, who was sentenced to four years in prison for felonious assault in 2011, was ordered to serve the balance of that sentence.

The violation also led to a new felony being filed against him. Posey pleaded guilty to felony 4 domestic violence and was sentenced to six months in prison, which will be served concurrently to the older sentence.

Thirty-two-year-old Charles Baker, of Galion, pleaded guilty to felony 4 theft and two counts of Charles Nathan Baker - breaking and entering, theft, hold for investigationfelony 5 breaking and entering. Baker received a 30-month prison sentence – 18 months on the fourth-degree felony and six months each on the fifth-degree felonies – and was ordered to pay $788.29 in restitution.

Tristan Pival was granted judicial release after serving roughly two months in prison. Leuthold placed Pival on five years of community control and entered her into his Intensive Supervision and Treatment program.

Pival pleaded guilty to receiving stolen property in July, but tested positive for marijuana while awaiting a pre-sentence investigation, which prompted Leuthold to have her spend a short stint in prison.
