MARION—Former Marion Municipal Court Judge Jason Warner and his wife Julia lost their appeal with the Third District Court of Appeals.
The Warners were found guilty of complicity by leaving the scene of an accident in April by retired Judge Patricia Cosgrove.
The Warner’s asked Judge Cosgrove for a report date, but she ordered them taken to prison immediately. Jason Warner’s attorney Sam Shamansky of Columbus, then immediately filed a motion
for their release pending the outcome of their appeal. Shamansky won their release in early May, pending the decision of the Third District Court of Appeals.
The court returned their 38-page opinion on Monday and upheld Judge Cosgrove’s Judgment.
The Warners, who were each sentenced to two years In prison, have until 8 am on Friday to report to the Marion County Sheriff’s office for transport back to prison.
Jason Warner will be incarcerated at the Lorain Correctional Facility, and Julia Warner will be returned to the Ohio Reformatory For Women at Marysville.
