BUCYRUS — Bucyrus Fire Department Chief Jay Keller has once again filed a lawsuit against the City of Bucyrus, Bucyrus Mayor Jeff Reser and Bucyrus Safety Service Director Jeff Wagner.
United States District Court Judge James Gwin dismissed Keller’s initial complaint in December.
“After several weeks of private negotiations the parties attempt to mediate a settlement was unsuccessful, and Chief Keller was forced to bring suit against the city again, this time in state court,” Keller’s attorney Adam Stone said in a news release.
According to the court document released by Stone, Keller believes he was the victim of age and disability discrimination.
According to the document, Keller was placed on leave July 20, 2017 after an anonymous complaint accused Keller “of essentially using racially insensitive slurs and ‘bullying’ employees/member of the Bucyrus City Fire Department.”
The filing says Keller was required to perform “unnecessary, age and disability inappropriate trainings and certification….”
The filing has 27 explanations of the three counts Keller now brings against the city, Reser and Wagner. The three counts are failure of due process, age discrimination and state disability discrimination.
Keller is seeking $75,000 in damages and wants the case heard in a jury trial.
