GALION, OH (CRAWFORD COUNTY NOW)—The City of Galion has raised concerns regarding the listing of the property at 825 Harding Way West, following a recent posting on Zillow.com that indicates the Levant-Dawson Trail bike path may fall within the boundaries of the property for sale.
On February 26, City officials discovered the real estate advertisement and promptly reviewed the details. The bike path, which serves as an important recreational asset for the community, was noted to be included in the property being sold.
City representatives reached out to the listing agent, Jane Kessler-Lennox of New Albany Realty, who confirmed during a return call that the bike path is indeed part of the property listing. City officials expressed their concerns about the bike path easement, which allows the City to utilize the trail that runs through the Levant property.
Following the conversation, City officials shared documentation related to the easement with Agent Kessler-Lennox, who assured them that she would review the information. A subsequent follow-up email from her office requested a signed copy of the easement document.
Further investigation by the City administration revealed that an easement had been officially filed with the Crawford County Recorder’s Office on March 31, 2017, and was signed by the property owner on February 23, 2017. The document stipulates, “The bike path easement granted herein and the rights, responsibilities, and obligations set forth shall be perpetual and shall run with the land and shall ensure to the benefit of, and be binding upon, the parties, their heirs, successors and assigns forever.”
City officials have reiterated that despite the inclusion of the bike path within the property listing, they will maintain their easement rights for its continued use. The City remains committed to preserving the Levant-Dawson Trail as a vital resource for residents and visitors alike.
