MANSFIELD, OH (CRAWFORD COUNTY NOW)—On Thursday in Mansfield, the State of Ohio filed a motion to dismiss the case against defendant Wesley Patrick.
Patrick was charged with voluntary manslaughter after a road rage incident last year.
According to Ontario police, Patrick and the victim, Andrew Westlund, 42, were both traveling south on Lexington Springmill Road in the area of U.S. 30 on December 21.
Westlund reportedly exited his vehicle and walked up to Patrick.
Police said Patrick told officers he rolled down his window and fired one round, striking Westlund.
The motion, submitted by the Richland County Prosecuting Attorney, requests that the court dismiss the charges without prejudice, meaning the state reserves the right to refile the case in the future.
The motion comes after the case was presented to a Grand Jury, which ultimately resulted in a “no bill,” indicating that the jury found insufficient evidence to proceed with the prosecution.
The court is expected to review the motion in the coming Days.
