Michael Banks, 28, of Bucyrus, was sentenced to 12 months in prison as a result of violating the conditions of his community control. Banks turned himself in after seeing an article on Crawford County Now’s website saying he was being sought for the violation.
In 2014, Banks was placed on five years community control and ordered to pay restitution of $3,400 to his victim, Kenneth Musselman. Banks’ Parole Officer Eric Bohach said that Banks failed to report his address and to keep his appointments.
In an agreed sentencing, Banks will be released after 90 days. Judge Sean Leuthold had some serious admonitions for Banks.
“Look, the only reason I am allowing you to come out of prison after 90 days is so that you can make restitution to your victim. I am very serious about making sure the victims of crime in Crawford County are made whole,” Leuthold said. “You’re 28-years-old and healthy. I expect you to get a job and get this $3,400 paid back. If you come out and don’t do that, I’m going to send you right back to prison and you will serve every single day. Do you understand me? I’m not going to let this slide.”.
In other court proceedings, Leuthold lowered the bond in the case of James Casewell of Bucyrus. Casewell appeared in court with his attorney Brian Gernert.
Appearing weak and shaky, Casewell listened as the Judge read the three-count indictment. He was indicted by the Grand Jury on charges of physical harm to a police officer and failure to comply, both third-degree felonies, and on charges of vandalism of property belonging to the Crawford County Sheriff’s Office.
Due to the level of care Casewell needs on a daily basis, Leuthold told Casewell, “Normally a bond on these charges would be between $250-300,000. But based on my conversations with our jail commander, your counsel and the prosecution, I believe that it is in your best interest to be at home where your fiancé can take care of you. I’m laying out some strict guidelines you must follow, and if you do not abide by the conditions the personal recognizance bond will be revoked and you will be placed back in jail.”
