BUCYRUS — A Crestline man appeared in Crawford County Common Pleas Court on Wednesday after he tested positive for marijuana in a routine drug screen.
Robert Heefner, 35, of Crestline has been free on bond since he was charged with felonious assault, a second-degree felony punishable by up to eight years in prison. According to allegations, Heefner was involved in an alcohol-induced altercation that resulted in a victim with a broken leg.
As a condition of his continued bond, Common Pleas Court Judge Sean Leuthold ordered Heefner tested once a week. According to probation officer Jeremy Clay, Heefner tested positive for marijuana. Clay said Heefner had been cooperative with his office. Clay said Heefner smoked the marijuana because he was stressed about issues in his personal life.
“What you should be stressed about is that you’re facing eight years in prison,” Leuthold said. “You should be worried about the opinion of the guy who decides your fate.”
Leuthold ordered the matter set for a full hearing for revocation of Heefner’s bond and instructed the probation department to take him into custody immediately if there were any additional violations. Heefner is represented by court-appointed attorney, Brad Starkey, who was not present at the proceeding.
In other court action, two warrants were issued for a Bucyrus man who posted bond and then fled the jurisdiction. Brent Stidham, 22, was awaiting trial on one count of weapons under disability, a third-degree felony punishable with up to three years in prison and one count of possession of drugs, a fifth-degree felony punishable with up to one year in prison.
According to probation officer Eric Bohach, information was received that Stidham had fled. When Bohach arrived to investigate, Stidham was gone. Leuthold ordered arrest warrants on each charge. Leuthold revoked Stidham’s bond and ordered him held without bond upon arrest.
William Kincade, 42, of Upper Sandusky pleaded guilty to a reduced charge of unauthorized use of a motor vehicle, a first-degree misdemeanor punishable with up to 180 days in jail. The original charge was a fifth-degree felony punishable with up to one year in prison.
As part of a plea agreement, Leuthold sentenced Kincade to 90 days in jail. He was ordered to pay restitution in an amount to be determined. Kincade must report to the Crawford County Justice Center to begin serving his jail sentence on July 15 at 7 p.m.
