A split second decision can be regretted in hindsight, but Judge Sean Leuthold argued that Jeremy Schaffer’s actions were not the culmination of such a choice.

Thirty-four-year-old Schaffer, of Bucyrus, admitted to violating his community control after he operated a vehicle under the influence of alcohol, obstructed law enforcement officers in their business, failed to report his police contact with his supervising officer, and consumed alcohol.

“I made a split second decision,” Schaffer confessed in Crawford County Common Pleas Court Tuesday afternoon.

Leuthold did not see it that way, however. He argued that Schaffer drank enough alcohol to have a blood alcohol level of .127, got in a vehicle and drove for a while, and then later got out of the vehicle in order to avoid the police. To cap it all off, Leuthold noted that Schaffer made numerous lies to the police.

“Occasionally, I do believe someone deserves a second chance,” Leuthold said, but followed that up by noting that Schaffer did not obey the rules of community control after being granted judicial release.

Leuthold re-imposed Schaffer’s 24-month prison sentence and advised the defendant to behave himself once he is released from prison.

Fifty-eight-year-old Timothy Moyer, of Mansfield, pleaded guilty to drug possession, a fifth-degree felony. He was placed on five years of community control, fined $1,250, and was ordered to forfeit seized drug-related property to the Crestline Police Department.

Twenty-eight-year-old Carolann Kogelschatz was granted judicial release after serving 18 months of a four-year prison sentence for burglary. She will be held in the Crawford County jail until a spot is available in a community-based correctional facility. After that, Kogelschatz will be placed on probation.
