Lucky’s Cash and Carry in Tiro proved to be unlucky for one Shelby man.
Twenty-year-old Jacob Diemer pleaded guilty to a felony two burglary charge in Crawford County Common Pleas Court Wednesday afternoon.
Diemer admitted to trespassing in an occupied structure with the purpose to commit a criminal offense on July 25. According to assistant prosecutor Ryan Hoovler, though Lucky’s Cash and Carry is a business, it was also set up as a habitation. Diemer was arrested along with 20-year-old Randle Battles of Tiro and a 16-year-old male juvenile from Shelby over a week after the burglary was reported to the Crawford County Sheriff’s Office.
Judge Russell Wiseman sentenced Diemer to four years in prison with a 76-day jail time credit. Diemer could be eligible for judicial release after serving 11 months. Upon his release from prison, Diemer must undergo a drug and alcohol assessment. He must also pay a $1,250 fine and restitution to the victim in the amount of $5,969.41.
Diemer’s alleged accomplice Battles is currently out on a personal recognizance bond with an ankle monitor due to health issues.
